Building a Car Accident Claim? Avoid These Common Mistakes
Putting together a car accident claim that actually results in fair compensation takes more than gathering evidence of liability and damages — it also means avoiding a few mistakes that can undermine an otherwise strong case from day one.
1. Postponing Treatment
It's common for car accident victims who can walk away from the scene to put off seeing a doctor. But a comprehensive medical evaluation soon after the crash matters for two reasons: some injuries (whiplash, concussions, soft-tissue damage) don't show symptoms right away, and a prompt exam creates a clear medical link between the accident and your injuries — one an insurance adjuster will look for reasons to dispute later.
2. Ignoring Doctor's Orders
Once you do seek care, follow through on it. Skipping follow-up appointments or returning to physical activity against medical advice gives an insurer an argument that your injuries weren't serious, or that you contributed to your own prolonged recovery.
3. Staying Active on Social Media
Insurance adjusters routinely monitor claimants' social media activity looking for anything that can be used to challenge a claim. Until your case is resolved, it's safest to:
- Set every profile to private and approve only people you actually know
- Avoid posting about the accident, your injuries, your recovery, or your finances
- Avoid “checking in” to public places
- Ask friends and family not to tag you in their posts
4. Waiting Too Long to Call an Attorney
Evidence can disappear quickly — surveillance footage gets overwritten, memories fade, and insurers move fast to lock in a low settlement before you understand the full extent of your damages. The sooner an attorney is involved, the more of that evidence can be preserved.
